(hereinafter referred to as “Gecko Supply”, “we”, “us” or “our”).

Gecko Supply GmbH operates the online store lyofood.ch and sells LYOFOOD products to customers in Switzerland and Liechtenstein.

This Privacy Policy explains how we collect, use, disclose and otherwise process personal data when you visit our online store, make a purchase, contact us or use other services available through lyofood.ch (the “Site”).

For customers and visitors in Switzerland, the processing of personal data is governed in particular by the Swiss Federal Act on Data Protection (FADP). Where applicable, in particular in relation to individuals in Liechtenstein, the General Data Protection Regulation (GDPR) and Liechtenstein data protection law also apply.

4. Shopify

Our online store is operated using the e-commerce platform provided by Shopify. Shopify processes personal data on our behalf to provide the technical infrastructure and functionality required to operate the online store.

For customers in Switzerland and the European Economic Area, personal data is initially processed by Shopify International Limited in Ireland. Shopify may subsequently use affiliated companies and service providers in other countries, including Canada and the United States.

5. Payments

We offer various payment methods, including credit card payments through Shopify Payments, TWINT and PayPal.

When you select a payment method, the information required to process the transaction may be transmitted to the relevant payment service provider. These providers process payment information in accordance with their own terms and privacy policies.

We do not necessarily receive or store complete credit card details ourselves.

6. LYOFOOD Sp. z o.o.

LYOFOOD Sp. z o.o., based in Kielce, Poland, is the manufacturer and brand owner of LYOFOOD products.

Authorised LYOFOOD employees have administrative access to the lyofood.ch Shopify store in order to support the administration, maintenance and operation of the LYOFOOD Switzerland online store.

As part of this access, authorised employees may have access to personal data contained within the Shopify store, including customer and order information, where necessary for these purposes.

Access is limited to authorised persons and should only be used for purposes connected with the administration and support of the online store.

7. Klaviyo and Marketing Communications

We use Klaviyo for email marketing and related customer communications.

If you subscribe to our newsletter or otherwise agree to receive marketing communications, information such as your name, email address, interaction with emails and, where applicable, information relating to your purchases or use of the Site may be processed through Klaviyo.

You can unsubscribe from marketing emails at any time by using the unsubscribe link contained in the respective email.

Klaviyo states that customer personal data processed on behalf of its customers can include names, email addresses, telephone numbers, IP addresses and cookie data.

8. Reviews and Product Availability Notifications

We use Judge.me Reviews to provide product review functionality on the Site. When you use this functionality, personal data necessary to provide and manage reviews may be processed by the service provider.

We also use Kbite: Back In Stock Notify Me to allow customers to request notifications when products become available again. If you use this function, the contact information you provide may be processed for the purpose of sending the requested availability notification.

These services may use cookies or similar technologies where necessary to provide their functionality.

9. Cookies and Similar Technologies

Our Site uses cookies and similar technologies to operate the online store and provide its functions. Cookies may also be used to remember preferences, analyse Site usage and, where activated, support marketing activities.

We use Consentmo GDPR Compliance to manage privacy and cookie preferences on the Site.

Depending on your location and the applicable legal requirements, you may be asked for consent before certain non-essential cookies or tracking technologies are activated.

- public authorities where disclosure is required by law.

Service providers receive personal data only to the extent necessary for the respective purpose, subject to applicable contractual and legal requirements.

12. International Data Transfers

Some of our service providers and business partners are located outside Switzerland or may process personal data in other countries.

This includes, in particular, international technology providers used to operate the Site.

Where personal data is transferred to a country that does not provide an adequate level of data protection, appropriate safeguards are used where required by applicable law, such as contractual data protection clauses or other recognised transfer mechanisms.

Shopify states that data from customers in Switzerland and the EEA is initially processed by Shopify International Limited in Ireland and may subsequently be transferred to Shopify entities and service providers in other countries. Shopify uses mechanisms including Binding Corporate Rules and contractual safeguards for applicable international transfers.

13. Data Retention

We retain personal data for as long as necessary to fulfil the purposes for which it was collected and to comply with applicable legal, accounting and regulatory requirements.

In particular, information relating to orders, payments and invoices may need to be retained after completion of an order in order to comply with statutory record-keeping obligations.

Marketing data is generally retained until you withdraw your consent, unsubscribe or the information is no longer required for the relevant marketing purpose, subject to applicable legal requirements.

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Individuals covered by the GDPR also have the right to lodge a complaint with the competent data protection supervisory authority. The Liechtenstein Data Protection Authority confirms these rights under the GDPR.
